1. Definitions and Interpretation
In these Terms of Service, the following definitions apply:
Means QuestFeed Pty Ltd (ABN 58 632 013 855), an Australian Private Company registered in Queensland. ZoneDSS is a product name and brand of QuestFeed Pty Ltd — it is not a separately registered business or trademark. All contractual obligations under these Terms are between the User and QuestFeed Pty Ltd.
Means the ZoneDSS application at app.zonedss.com, the marketing website at zonedss.com, and all associated APIs, infrastructure, and services.
Means all planning intelligence services provided through the Platform, including planning control identification, risk scoring, AI-powered planning Q&A, site planning reports, compliance checking, and property monitoring.
Means any individual or entity accessing or using the Platform or Services, whether on a free or paid subscription.
Means a planning report (such as a Home Buyer's Report, Home Owner's Report, Developer's Report, or other persona-specific report), compliance risk assessment, or other analysis output generated by the Platform for a specific property or address.
Means the ZoneDSS business directory where trades, professional, and service businesses can be listed and discovered by property owners, and where Business Users can pay to promote their listing.
Means prepaid units, denominated in Australian dollars, that a Business User buys and redeems only for ZoneDSS marketing services (such as featured placement, per-enquiry charges, and gift reports). Credits are not money, are not redeemable for cash, and are not a stored-value or payment facility usable for anything other than ZoneDSS services.
Means a User who creates, claims, or manages a business listing on the Marketplace.

3. Acceptance of Terms
By accessing or using the Platform, you acknowledge that you:
- Have read, understood, and agree to be bound by these Terms of Service
- Have read and agree to our Privacy Policy
- Are at least 18 years of age or have legal authority to enter these Terms on behalf of an organization
- Will use the Platform only for lawful purposes and in accordance with these Terms
- Have the authority to bind the organization you represent (if applicable)
Changes to Terms: We may modify these Terms at any time. Material changes will be communicated via email to registered users. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.
4. Authorized Use & Prohibited Conduct
You must NOT:
- Attempt to gain unauthorized access to the Platform, its infrastructure, or other users' data
- Use the Platform to facilitate fraud or unauthorized activities
- Attempt to reverse engineer, decompile, or extract our proprietary planning analysis technology, scoring algorithms, or AI models
- Use automated tools to scrape, crawl, or extract data from the Platform beyond normal API usage
- Resell, sublicense, or redistribute our Services or Reports without written authorization
- Misrepresent ZoneDSS Reports as formal planning assessments or statutory compliance certificates
- Use the Platform in violation of any applicable local, state, national, or international law
5. Subscriptions & Payment
Service Tiers
ZoneDSS offers subscription tiers with varying access to reports, assessments, monitoring, and features. Certain features may be available on a pay-per-report or pay-per-assessment basis. Current tiers, inclusions, and prices are set out on our Pricing page, which forms part of these Terms by reference.
Billing
Paid subscriptions are billed monthly or annually in advance via Stripe. All prices are in Australian Dollars (AUD) and exclude GST unless otherwise stated. You authorize us to charge your nominated payment method on a recurring basis until you cancel. Reports and pay-per-use purchases are billed at the time of purchase.
Cancellation
You may cancel your subscription at any time through your account settings or the Stripe customer portal. Cancellation takes effect at the end of the current billing period. You will retain access until the end of that period.
Refunds
Subscriptions, report and assessment purchases, and credit top-ups are paid in advance and are non-refundable for change of mind or simply because they are unused, and we do not provide pro-rata refunds for the remainder of a billing period on cancellation. However, nothing in this clause limits your rights under the Australian Consumer Law — where you are entitled to a remedy (including a refund) for a failure to meet a consumer guarantee, that remedy applies. If we suspend or terminate your account other than for your breach or misconduct, we will refund or credit the unused portion of any prepaid fees or purchased Credits. Refunds relating to marketing Credits are dealt with in Section 6.
Price Changes
We may change subscription prices or pay-per-use fees with 30 days' advance notice to registered users. Changes take effect at the start of your next billing period for subscriptions, or at the time of purchase for pay-per-use fees. If you do not agree to a price change, you may cancel before it takes effect.
Taxes
You are responsible for any applicable taxes, duties, or levies (other than taxes on our net income). If GST or equivalent tax applies, it will be added to the listed price and shown on your invoice.
Failed Payments
If a payment fails, we may suspend or downgrade access to paid features until payment is received. You remain liable for unpaid fees. Repeated failure to pay may result in termination of your account.
6. Marketplace & Marketing Credits
This section applies to Business Users who list a business on the ZoneDSS Marketplace and to the prepaid Marketing Credits used to promote those listings. It applies in addition to the rest of these Terms.
a. Business Listings
The Marketplace is a directory where trades, professional, and service businesses can be listed and discovered by property owners. If you create or claim a listing, you warrant that the information is accurate and that you are authorised to manage that business. We may review, edit, suspend, or remove a listing that we reasonably believe is inaccurate, misleading, fraudulent, or in breach of these Terms. We do not guarantee any level of visibility, enquiries, leads, or work resulting from a listing.
b. Marketing Credits
Marketing Credits ("Credits") are prepaid units, denominated in Australian dollars (approximately A$1 per Credit), that a Business User buys and redeems only for ZoneDSS marketing services — for example featured placement, per-enquiry charges, and gift reports. Credits:
- — are redeemable only for ZoneDSS services and have no cash value; they cannot be withdrawn, exchanged for cash, or used outside the Platform;
- — are not money, a stored-value facility, or a means of payment to any third party (Credits form a closed-loop arrangement in which we are the only redeemer);
- — are tied to the listing they are purchased for and are non-transferable between accounts, listings, or businesses (this protects against fraud and abuse);
- — may include bonus Credits on larger packages, which are clearly identified at the time of purchase.
c. Credit Expiry
Purchased Credits do not expire. Promotional, bonus, and referral Credits that we grant for free are valid for the period stated when they are granted (by default 90 days), and may be withheld, reduced, or cancelled where we reasonably suspect fraud, abuse, or breach of these Terms. We will tell you the expiry of any promotional Credits at the time we grant them.
d. Featured Placement
Featured placement increases the prominence of your listing for the period you pay for. It is a visibility service only — we do not guarantee any number of views, enquiries, leads, or jobs, and outcomes depend on factors outside our control.
e. Pay-Per-Enquiry
If you enable pay-per-enquiry, a set number of Credits is deducted each time you receive a customer enquiry through your listing. We want this to be fair, so we will credit back the Credits for an enquiry that is invalid — for example a duplicate, obvious spam, a test, a clearly fake enquiry, or one we failed to deliver to you — provided you report it to us within 7 days of receiving it. We may also credit back enquiries we identify as invalid ourselves.
f. Referral Rewards
From time to time we may offer Credits for referring another business that joins the Marketplace. Referral rewards are promotional Credits (see paragraph c), are limited to one reward per referred business, and may be withheld or reversed for self-referral, fake or duplicate accounts, or other abuse. If you share a referral link, you are responsible for doing so lawfully — including complying with the Spam Act 2003 (Cth) and not sending unsolicited electronic messages.
g. Gift Reports
Gift reports are co-branded property reports that you generate to share with your own customers. You confirm that you have the right to contact each recipient and to provide them with a report, and you are responsible for your use of the reports and for complying with applicable privacy and anti-spam laws. We provide the report-generation tooling only and are not a party to your relationship with your customers.
h. Refunds on Credits
Credits are paid in advance and are non-refundable for change of mind or simply because they are unused. However, nothing in this section limits your rights under the Australian Consumer Law: where you are entitled to a remedy (including a refund) because a paid service was not supplied with due care and skill, was not fit for purpose, or was not supplied at all, that remedy applies. If we close or suspend a listing other than for your breach or misconduct, we will refund or re-credit the unused balance of any purchased Credits (promotional Credits have no cash value).
i. Changes to Marketplace Pricing
We may change the price of credit packages or the number of Credits charged for a service. Changes apply only to purchases and charges made after the change takes effect, and the current rates are shown in the Platform before you buy or spend. Credits you have already purchased keep the value they had when bought.
7. Report Accuracy and Limitations
Accuracy Notice
While we use advanced planning analysis technology, risk scoring, spatial data, and AI-powered analysis to provide comprehensive planning intelligence, our Reports are informational and do not constitute professional planning advice or statutory compliance certificates. Always consult a qualified town planner or planning lawyer before making critical planning decisions based on our Reports.
Our Reports are subject to the following limitations:
- — Reports are based on the planning instruments and spatial data currently loaded in our system; instruments may have been amended after our last update
- — Spatial overlay data (height, FSR, heritage) is sourced from NSW government datasets and may not reflect the most recent gazette notices or amendments
- — Approval likelihood scores are probabilistic and should be interpreted as guidance, not certainty of approval or refusal
- — AI-powered Q&A answers are based on planning control data but may occasionally misinterpret context or miss nuances that a human planner would catch
- — Not all environmental overlays (flooding, bushfire, contamination, acid sulfate) are currently loaded for all LGAs
- — Our platform does not replace a formal Statement of Environmental Effects or DA assessment by a qualified planner
8. Intellectual Property
The Platform and its original content, features, and functionality are owned by QuestFeed Pty Ltd and protected by international intellectual property laws. This includes:
- — The ZoneDSS name, logo, and branding
- — Platform design, layout, and user interface
- — Planning control analysis methodology, data structures, and scoring algorithms
- — AI models and planning Q&A technology
- — Report formats, risk scoring frameworks, and analysis methodology
Report License
Reports generated by ZoneDSS are licensed to you for your internal business purposes. You may share Reports with your clients, planning consultants, and project team members. You may not resell, publicly redistribute, or use our Reports or methodology to create competing services without prior written consent.
9. Disclaimers and Limitations
Disclaimer of Warranties
To the maximum extent permitted by law, the Platform and Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to:
- — Implied warranties of merchantability or fitness for a particular purpose
- — Warranties that the Platform will be uninterrupted, error-free, or free of harmful components
- — Warranties regarding the accuracy, completeness, or currency of planning data or control analysis
- — Warranties that our Reports will identify all applicable controls or predict development approval outcomes
Limitation of Liability
To the maximum extent permitted by Australian law:
- — We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill
- — Our total aggregate liability for all claims arising from or relating to the Services shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim
- — We are not liable for DA refusals, council enforcement actions, or development losses arising from actions taken or not taken based on our Reports
- — We are not liable for damages arising from changes to planning instruments that occur after our data was last updated
Consumer Guarantees
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified by agreement.
10. Additional Terms
a. Confidentiality
We treat all Reports, query history, and account data as confidential. We will not disclose your data to third parties except: (i) with your explicit consent, (ii) to our service providers under confidentiality obligations, (iii) when required by law or valid legal process, or (iv) in anonymized, aggregated form that cannot be attributed to you.
b. Indemnification
You agree to indemnify, defend, and hold harmless QuestFeed Pty Ltd, its officers, directors, and employees from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (i) your violation of these Terms, (ii) your misrepresentation of ZoneDSS Reports as formal planning assessments, or (iii) your use of the Services in violation of applicable law.
c. Termination
We may suspend or terminate your access immediately and without prior notice if you: breach these Terms, engage in fraudulent or unlawful activity, or abuse the Platform. Upon termination, your right to use the Platform ceases immediately. We may retain your data as required by law or our data retention policy.
d. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, pandemics, war, government actions, internet outages, or third-party service failures.
e. Governing Law
These Terms are governed by and construed in accordance with the laws of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia for any disputes arising from these Terms.
f. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and ZoneDSS regarding the Services.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
